Agreement to these terms
 

These Terms of Service ("Terms") are a binding agreement between you and Simply PetWell LLC ("Simply PetWell," "we," "us," or "our"). They govern your use of simplypetwell.com (the "Site") and your purchase and use of our consultations, written reports, worksheets, guides, and any other materials or services we provide (together, the "Services").
 

By using the Site, booking a consultation, or purchasing anything from us, you agree to these Terms, our Privacy Policy, and our Disclaimer, all of which are incorporated here by reference. If you do not agree, do not use the Site or the Services.

Who may use the Services
 

You must be at least 18 years old and able to enter into a binding contract. You must be the owner of the dog discussed, or have the owner's authority to make decisions about that dog's care and to share the dog's information with us.

What we provide, and what we do not
 

Simply PetWell provides educational canine nutrition consulting. A standard engagement includes a written intake questionnaire, a scheduled consultation held by video or phone, and a written report with individualized recommendations and supporting materials. The precise contents are described on the Site at the time of booking. We currently serve dogs only.
 

Sophia Banta is a certified Pet Nutrition Coach and holds RACE approved provider credentials. She is not a licensed veterinarian. Simply PetWell does not practice veterinary medicine and does not:
 

  • Diagnose, treat, cure, or prevent any disease or medical condition

  • Prescribe, adjust, or discontinue medication

  • Replace your veterinarian, or replace examination, testing, or treatment

  • Formulate therapeutic or prescription diets for a diagnosed medical condition independently of your veterinarian

  • Create a veterinarian client patient relationship of any kind
     

Where your dog has a diagnosed condition, or where a condition is suspected, our role is to provide nutrition education that supports the care your veterinarian directs. We may ask you to confirm recommendations with your veterinarian before you act on them, and we may decline or end an engagement where we believe veterinary involvement is required. Our full Disclaimer forms part of these Terms.

Booking, scheduling, and payment
 

Consultations are booked through our scheduling provider and paid through our payment processor at the time of booking. Your appointment is confirmed only when payment has been received and you have received a confirmation.

Prices are listed on the Site and may change at any time. The price shown at the time you book is the price that applies to that booking. All prices are in U.S. dollars. You are responsible for any taxes that apply to your purchase and for any fees your bank or card issuer charges, including foreign transaction fees.

You agree to provide accurate, current, and complete billing information.

Intake form and preparation
 

We email your intake form to you after booking. Your completed form must be returned at least 24 hours before your appointment. The intake form is what makes the consultation individualized. If it is not returned in time, we may need to reschedule your appointment, and the rescheduling terms in Section 6 will apply.

Cancellations, rescheduling, and missed appointments
 

  • Rescheduling. You may reschedule at no charge if you give us at least 24 hours notice. You may reschedule once per booking without additional charge. Further changes may require a new booking at the current rate.

  • Cancellation. If you cancel with at least 24 hours notice and before we have begun preparing your file, you may request a refund as described in Section 7.

  • Late arrival. Your appointment ends at its scheduled end time regardless of when it begins. If you are more than 15 minutes late without notice, we may treat the appointment as missed.

  • Missed appointments. If you do not attend and did not give notice, the appointment is forfeited and the fee is not refundable.

  • Our cancellations. If we must cancel or reschedule, you may choose a new time at no charge or receive a full refund. Where a technical failure on our side interrupts a session, we will reschedule the remaining time at no charge.

Refunds
 

Because our Services involve preparation, analysis, and the delivery of custom written work, refunds are limited:
 

  • Before we begin reviewing your intake form, a cancellation made within the notice period in Section 6 is refundable in full, less any non recoverable payment processing fees.

  • Once we have begun reviewing your intake form or preparing your file, the fee is non refundable.

  • Once the consultation has taken place or the written report has been delivered, the fee is non refundable.

  • Digital products, printables, and downloadable guides are non refundable once delivered or downloaded, because they cannot be returned.
     

Refunds are not available because you disagree with our recommendations, because you chose not to follow them, or because your dog's outcome differed from what you hoped for. Outcomes depend on many factors outside our control. See Section 13.

If you believe something went wrong, contact us first at contact@simplypetwell.com. We would rather fix a problem than lose a client over one.

Your responsibilities
 

You agree that:
 

  • The information you give us about your dog will be accurate and complete to the best of your knowledge. Our recommendations are only as good as the information they are based on.

  • You will tell us about current diagnoses, medications, supplements, and known allergies.

  • You will consult your veterinarian before making significant changes to your dog's diet, supplements, or routine, and before acting on any recommendation that concerns a diagnosed condition.

  • You will introduce changes gradually as directed and monitor your dog's response.

  • You will stop any change and contact your veterinarian if your dog shows signs of illness, distress, or an adverse reaction.

  • In an emergency you will contact a veterinarian or an emergency veterinary hospital immediately. We are not an emergency service and cannot respond to urgent medical situations.

  • You remain solely responsible for all decisions about your dog's care. Our recommendations are information for you to evaluate, discuss with your veterinarian, and accept or decline.

Deliverables and intellectual property
 

Our materials. All content on the Site, and all reports, plans, worksheets, printables, guides, templates, graphics, and written materials we produce, are owned by Simply PetWell LLC and protected by copyright and other intellectual property laws.
 

Your license. When you purchase a consultation or a digital product, we grant you a personal, non exclusive, non transferable, revocable license to use the materials you receive for the care of your own dog or dogs within your own household. You may print them for that purpose and you may share them with your own veterinarian or care team.
 

What you may not do. You may not resell, sublicense, republish, distribute, upload to any public or shared platform, use for commercial purposes, use to train any machine learning or artificial intelligence system, or create derivative works from our materials. You may not remove copyright or attribution notices. You may not use our name, logo, or credentials to imply endorsement of any product, service, or business without our written permission.
 

Your content. You keep ownership of everything you send us, including intake forms, photos, videos, and messages. You grant us a limited license to use that content solely to deliver the Services to you. Any public use is governed separately by Section 8 of our Privacy Policy and requires your specific written permission.

Acceptable use of the Site
 

You agree not to use the Site to break any law, infringe anyone's rights, transmit malicious code, attempt to gain unauthorized access to our systems or accounts, scrape or harvest content by automated means, or interfere with the Site's operation. You agree not to misrepresent your identity or your relationship to a dog in your care.

Third party services, links, and affiliate relationships
 

The Site and our materials may reference or link to third party products, brands, retailers, laboratories, practitioners, or resources. These references are provided for convenience and education. We do not control those third parties, we do not guarantee their products or services, and we are not responsible for anything you purchase from them or any harm arising from their products.
 

We do not currently participate in affiliate programs. If that changes, any affiliate relationship will be clearly disclosed, and our recommendations will continue to be made on the merits rather than on commission.

Confidentiality
 

We treat what you share with us as confidential. We do not disclose your information or your dog's information except as described in our Privacy Policy, or where disclosure is required by law or reasonably necessary to prevent serious harm to a person or an animal.

No guarantees and disclaimer of warranties
 

We do not guarantee any particular result. Every dog is different. Genetics, age, underlying conditions, medications, environment, stress, compliance, product availability, and factors nobody can see all affect outcomes. Results described by other clients are their experiences and are not a prediction or promise of yours.
 

The Site, the Services, and all materials are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non infringement. We do not warrant that the Site will be uninterrupted, timely, secure, or error free, or that our materials are complete, current, or free of error.
 

Nutrition science evolves, product formulations change without notice, and information that is accurate when written may not stay accurate.
 

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

Limitation of liability
 

To the fullest extent permitted by law, Simply PetWell LLC and its owner, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to the Site, the Services, or these Terms, whether based in contract, tort, negligence, strict liability, or any other theory, even if we have been advised of the possibility of such damages.
 

To the fullest extent permitted by law, our total aggregate liability for all claims relating to the Site or the Services will not exceed the amount you actually paid us for the Services giving rise to the claim during the twelve months preceding the event.
 

This includes, without limitation, any claim arising from illness, injury, adverse reaction, worsening of a condition, veterinary expense, or death of an animal following any recommendation, plan, or information provided by us.
 

Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud, gross negligence, or willful misconduct. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Assumption of risk
 

You understand that changing a dog's diet, adding supplements, or altering a routine carries inherent risk, including digestive upset, allergic or adverse reactions, refusal to eat, weight change, nutrient imbalance, and interaction with medication or an existing condition. You voluntarily accept those risks and accept full responsibility for the decisions you make about your dog.

Indemnification
 

You agree to indemnify, defend, and hold harmless Simply PetWell LLC and its owner, employees, and contractors from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising out of or related to your use of the Site or the Services, your breach of these Terms, your violation of any law or third party right, the accuracy of the information you provide to us, or any decision you make about the care of your dog.

Right to decline or end service
 

We may decline a booking, end an engagement, or issue a refund and discontinue service at our discretion, including where we believe a situation requires veterinary care rather than nutrition education, where the information provided is incomplete or inaccurate, where a request falls outside our scope or credentials, or where a client is abusive to us. Where we end an engagement before delivering the Services, we will refund the unearned portion of the fee.

Dispute resolution, governing law, and venue
 

Talk to us first. If a dispute arises, you agree to contact us at legal@simplypetwell.com and give us 30 days to resolve it informally before starting any formal proceeding. Most problems can be solved this way.
 

Mediation. If informal discussion does not resolve the dispute, the parties agree to attempt mediation in Los Angeles County, California, with costs shared equally, before filing suit, except where a party seeks injunctive relief or brings a claim in small claims court.
 

Governing law and venue. These Terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any action that proceeds to court must be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to that jurisdiction.
 

Time limit. Any claim relating to the Site or the Services must be brought within one year after the claim arises, to the extent permitted by law.
 

No class actions. To the extent permitted by law, disputes will be resolved individually, and you agree not to bring or participate in any class or representative action against us.

General terms
 

Entire agreement. These Terms, together with the Privacy Policy and the Disclaimer, are the entire agreement between us regarding the Services and supersede any prior discussions, proposals, or representations.
 

Severability. If any provision is found unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will stay in full force.
 

No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
 

Assignment. You may not assign these Terms. We may assign them in connection with a sale or transfer of the business.
 

Force majeure. We are not liable for delay or failure to perform caused by events beyond our reasonable control, including illness, power or internet failure, platform outage, natural disaster, or government action. In such cases we will reschedule or refund.
 

Survival. Sections 9, 12, 13, 14, 15, 16, 18, and 19 survive termination.
 

Independent relationship. Nothing in these Terms creates a partnership, employment, agency, or franchise relationship between us.

Changes to these Terms
 

We may update these Terms at any time by posting a revised version on the Site with a new "Last updated" date. Changes apply to bookings made after the revision. Your continued use of the Site or the Services after an update means you accept the revised Terms.
